Major Blow to Transgenders Across America – Equality has Failed!

  • While some states still have a discrimination ban against insurance and health caregivers discriminating against sex and gender, most states including Texas do not protect Gender Identity, only Sex. 
  • This protection is what many transgender people in the United States were relying on to get the care they desperately need.

I have previously written about Transgender Healthcare in Texas (or the lack thereof) and the Hardships of a Transgender Person in Texas, and yet again I am here writing more about the issue. I will continue upon those stories as more and more things happen to LGBT individuals every day.

Now, not only are the issues of healthcare for transgender being challenged by the federal government and states, recently the JUDGE WHO RULED OBAMACARE UNCONSTITUTIONAL HAS OVERTURNED HEALTH PROTECTIONS FOR TRANSGENDER PATIENTS.

Thus creating even more worries for transgender people in the United States. While some states still have a discrimination ban against insurance and health caregivers discriminating against sex and gender, most states including Texas do not protect Gender Identity, only Sex.

While most say these are the same thing, the government and legal representatives for the health industry state that is is not the same, that they can deny on the basis of gender, since they are not discriminating due to sex, per the law.

This protection is what many transgender people in the United States were relying on to get the care they desperately need and with this new ruling, which I am sure will be appealed, it stops the protections for transgenders all over the United States.

I wrote previously about how the Texas Medicaid system covers the transgender gender-confirming surgeries, but no clinics in Texas would accept the insurance for these procedures.

With this new revoked law from this judge, it will now be even harder for states to try to pass mandates to make sure clinics and insurance companies cover these procedures.

I hear every day how taxpayers do not want the state insurance or the government insurance to cover gender-confirming surgeries, but yet these same taxpayers are OK with insurance to cover plastic surgery and non-life threatening conditions, such as pain relief procedures, etc.

But as I have told everyone these gender confirming surgeries are sometimes life-threatening and necessary for the person to live. An excerpt from my previous blog post says “Remember some of these are necessary surgeries due to health complications due to the T-blockers being taken. If these individuals get the surgery, they can stop taking the t-blocker all together, minimizing the damage to their kidneys.”

Which in most cases is the real reason these are necessary, as they will die without these procedures? At the same time costing insurance companies and taxpayers even more, because they will have to go through dialysis and eventual kidney transplants. If they are lucky.

But since they are in transition, most clinics would rule they are unfit for a kidney transplant because of it.

People do not understand the dire need for these so-called “elective surgeries.”

Elective surgery is one that is not necessary (i.e. plastic surgery), or one that is elected to have, such as body contouring, facial feminization, or breast augmentation.

The gender-confirming surgery, many argue, falls into this “elective” category. But that is not true, it is necessary for many individuals to live a happy normal life.
