China New Civil Code

  • The new Civil Code is also attached to the Social Credit System.
  • Russian phone numbers are banned from registering in the WeChat platform.
  • The new code is inline with the Chinese totalitarian regime.

China rolled out the new Civil Code. It should be noted, the Civil Code never previously existed in China. The New Code is available here. Furthermore, the Civil Code consists of the 7 chapters and 1260 articles. These chapters include provisions for the property rights, the individual rights, marriage, family the inheritance and the every day offenses.

Justinian I, also known as Justinian the Great, was the Eastern Roman emperor from 527 to 565. His reign is marked by the ambitious but only partly realized renovatio imperii, or “restoration of the Empire”. This ambition was expressed by the partial recovery of the territories of the defunct Western Roman Empire.

Historically, the earliest now civil code was the Code of Ur-Nammu, which was implemented in the 2100 BC. In addition, the Corpus Juris Civilis (the Roman Law) was created in the 529 AD by the Justinian I.

Moreover, the child born out of the wedlock has the same rights to the inheritance, as if the child was born during the marriage. There are other nuances as well. Nevertheless, the new Civil Code is also attached to the Social Credit System.

Chapter 1 and 7 are the most interesting ones. In the Chapter 1 of the Civil Code “The system of multi-party cooperation and political consultation led by the Communist Party of China will continue to exist and develop for a long time.

All the people of the country, all State bodies and armed forces, all political parties and public organizations, enterprises and institutions are guided by the provisions of the Constitution as the main criterion for their activities, including being  responsible for  the observing the Constitution and implementing it.”

Article 1-The People’s Republic of China is a socialist State of the democratic dictatorship of the people, led by the working class and based on the union of workers and peasants.

The socialist system is the main system of the People’s Republic of China. The leadership of the Chinese Communist Party is the most essential feature of socialism with Chinese characteristics.

It is forbidden for any organizations or individuals to undermine the socialist system. This clearly denies anyone any right to speak against the Chinese government.

WeChat is a Chinese multi-purpose messaging, social media and mobile payment app developed by Tencent. First released in 2011, it became the world’s largest standalone mobile app in 2018, with over 1 billion monthly active users.

Article 5-All State bodies and armed forces, political parties and public organizations, enterprises and institutions must comply with the Constitution and laws.

Any violation of the Constitution and laws must be brought to justice. No organizations or individuals should enjoy privileges that go beyond the scope of the Constitution and laws.

Hence, Chinese populous can not have their opinions that are not in line with the Communist party.  The surprising fact that Russian phone numbers are blacklisted to register on the Chinese main social media network and business app WeChat. Yet, China and Russia seem to have a symbiotic relationship.

Article 7- The sector of the economy based on state ownership. Therefore,  the socialist economy based on the system of public ownership, is the leading force in the national economy.

The State guarantees the strengthening and development of the sector of the economy based on State ownership. At the end, an average Chinese citizen never truly owns the property in China.

However, China is encouraging everyone to be online and even people from the remote Chinese villages encouraged to sell their products on the social media. Hence, it allows Chinese government to control the people even more.

Overall, it is clear, the new Civil Code is not even close to the one adapted by the West. The code is just another communist manifesto with the Western parallel. It is purely the strategic move for the propaganda purposes by the Chinese government.
